I really don't understand this at all; don't creators at TSR use GOS creations & then 'redistribute' them? How is that any different? TSR actually host the files themselves, and GOS doesn't. And GOS creators do a huge amount of work for their uploads, especially recolour/retexture uploads, which is more than I can say for some of the stuff at TSR.
You've probably already seen this, but if there's anything you can salvage from TSR's argument in their 'myths' article to use in your defense (particularly the pay-site part with the EA legal quote), see here: http://www.thesimsresource.com/articles/myths
All of this is quite ironic considering that (supposedly) 'TSR was created with an ethos to "Create & Share"'. I guess that disappeared when they decided to have subscriptions.
This whole thing just confuses me, but it's completely outrageous. I hope it's all sorted out soon, GOS is one of the best content sites there is, if not the best. You all do a really great job.
